The UNITED STATES JUSTICE FOUNDATION (USJF), through its MINUTEMAN PROTECTION PROGRAM (MPP), today announced that it had obtained the dismissal of all charges against STEVEN SHINE, a member of the Minuteman Civil Defense Corps (MCDC), resulting from an incident on October 28, 2006.

At that time, MR. SHINE was protesting against illegal immigration when he was attacked by a woman who apparently supported illegal immigration.

An Oceanside Police Department Officer approached MR. SHINE and asked if he wanted to press charges against the woman. MR. SHINE commented to the police officer that he had been attacked once before and had done nothing about it, but this time he wanted the attacker prosecuted.

The woman was then arrested and taken into custody. Shortly thereafter, representatives of the Oceanside Police Department arrested MR. SHINE on a charge of possessing a gravity knife, an illegal weapon.

Incidentally, after the woman that had attacked MR. SHINE had been arrested, she was identified as the daughter of a retired Oceanside Police Department Officer and released.

Subsequently, through the efforts of the USJF Staff Attorney, ALLISON PAINO, it was shown to the San Diego County District Attorney’s Office that the knife in question was indeed legal and, as a result, the charges were dropped.

According to ALLISON PAINO,

“It was not lost on the staff of USJF that Mr. Shine was arrested only after he expressed his desire to press charges against the woman who attacked him, who was purportedly the daughter of a retired Oceanside Police Department Officer. This is not the first time that the Oceanside Police Department Officers have improperly arrested someone.

We are currently preparing a lawsuit on behalf of another member of the Minuteman Civil Defense Corps who was arrested, held for four days in jail, denied access to necessary medical treatment, only to have the charges subsequently dropped by the District Attorney’s Office.

This type of blatant abuse of the constitutional rights of those who oppose illegal immigration does nothing but give a bad name to law enforcement agencies everywhere and, specifically, that of the City of Oceanside.”

USJF is a nonprofit, conservative, legal action foundation, headquartered in Ramona, California.
